The TCPA provides a private right of action — meaning individual consumers can sue you directly for violations, not just the FCC. Class action lawsuits under the TCPA are common and expensive. A single poorly documented consent process or improperly handled opt-out can expose your business to class action risk even if only a small number of messages were sent non-compliantly.
